Shar-Pei Adoption Agreement

THE ADOPTER ACKNOWLEDGES AND UNDERSTANDS that the temperament, pedigree and health of this Dog may not be fully known, and does hereby assume full responsibility for any and all actions of, and for any personal injuries and/or damages that may be caused hereafter by the Dog, and hereby remises, releases and forever discharges THE OWNER from any claim, loss or liability whatsoever arising from or relating in any way to the Dog. THE ADOPTER AGREES to indemnify and hold harmless THE OWNER from and against any and all claims, damages, losses, fees or costs arising from or relating to any and all claims relating to the Dog, including claims for personal injuries or damages caused by the Dog.

THE OWNER makes no warranty, expressed or implied, regarding the Dog or the health, condition, age, pedigree, personality or temperament of the Dog.

THE ADOPTER shall provide a secure fenced yard for the Dog, proper grooming, nutrition, exercise and necessary veterinary care for the Dog. THE ADOPTER further agrees that the Dog shall be a house dog, allowed to sleep indoors and protected from inclement or adverse conditions and shall not be housed or kept in a yard or chained. The Dog will not be allowed to roam free or unsupervised. THE ADOPTER shall treat the Dog as a household pet, companion and family member and never use the Dog as an aggressive "guard dog" or for dog fighting or any other "sport" in which one animal is pitted against another, including hunting of any kind. The Dog shall not be transported unsecured, in an open area of any truck or utility vehicle.

THE ADOPTER shall comply with any and all local, county and state regulations and laws relating to the ownership, care, feeding and sheltering of the Dog, and shall at all times maintain a current license for the Dog.

If the Dog has not been sterilized prior to this adoption, THE ADOPTER AGREES to neuter/spay the Dog upon the reaching of its sexual maturity, but in no event later than _____ and to bear any and all expense for same. The Dog will not be bred, whether accidental or intentional, prior to being sterilized.

THE ADOPTER UNDERSTANDS that said dog may have been utilized in breeding and/or showing activities prior to the execution of this agreement, and that THE ADOPTER shall have no residual rights with respect to any of said dog's produce/get or showing activities.

THE ADOPTER AGREES to notify THE OWNER in writing in the event that THE ADOPTER plans to relocate to a different place of residence, and agrees to provide THE OWNER with a forwarding address.

THE ADOPTER AGREES to permit THE OWNER, upon reasonable notice and at reasonably convenient times to visit THE ADOPTER's home, or such facility wherein the Dog is housed, for the purpose of verifying that the Dog is in healthy condition, and in compliance with all of the terms and conditions of this Agreement. In the event THE ADOPTER does not comply with the terms of this Agreement, or the Dog is abused or neglected, in the reasonable opinion of THE OWNER, THE OWNER may revoke the adoption and recover the Dog. Promptly upon demand by THE OWNER, THE ADOPTER shall surrender the Dog to THE OWNER, and THE ADOPTER authorizes THE OWNER to enter THE ADOPTER's property and residence to recover the Dog.

THE ADOPTER may not abandon, give away, gift, sell, transfer to a shelter or otherwise transfer the dog, and shall notify THE OWNER immediately at any time you determine you no longer want to, or no longer can, keep the Dog, so THE OWNER can take the Dog back or arrange another adoption. In the event that THE ADOPTER for any reason is unable to provide a home for the Dog, the dog must be returned to THE OWNER, at THE ADOPTER'S expense. The Dog may not be euthanized except in the case of the Dog's terminal illness or injury, or old age accompanied by pain and suffering and with the concurring opinion of a licensed veterinarian. A licensed veterinarian or veterinarian technician in a private clinic or hospital must perform the euthanasia.

THE OWNER requires a $____ adoption fee for the adoption of a the Dog. Within 30 days of the date of this Agreement, THE ADOPTER may return the Dog to THE OWNER for any reason and the adoption fee will be refunded to THE ADOPTER. No refunds will be made for any costs incurred by THE ADOPTER during this 30-day period, i.e., food, leash/collar, vet bills, etc. After 30 days, the Dog may be returned to THE OWNER, but the adoption fee will not be refunded. THE ADOPTER shall have the Dog examined by a licensed veterinarian within 30 days of the date of this Agreement to ascertain the Dog's health and condition and purchase heartworm preventative. A copy of this receipt must be mailed to THE OWNER no later than 45 days after the date of this Agreement. THE ADOPTER shall have the Dog examined by a licensed veterinarian not less than yearly thereafter and keep all vaccinations current and administered heartworm preventative as required by the veterinarian. In the case of illness or injury, THE ADOPTER shall seek prompt veterinary care for the Dog.

This Agreement is the entire agreement between the parties and may not be changed or modified except by a writing signed by both parties. In the event that any part of this Agreement is determined to be invalid, the rest of the agreement shall remain in full force and effect. This Agreement shall be binding upon the parties and their respective heirs, executors, administrators and assigns.
